By creating a child profile associated with a School account and permitting a child to use the SurfWisely Service, in addition to acceptance of our Privacy Policy and Terms of Use, you expressly agree to the practices described in this Children’s Privacy Notice and you consent to the collection, use, and disclosure of the Child’s personal information as described herein.

  1. Does SurfWisely collect personal information from children?

SurfWisely does not permit children to create an account and does not knowingly collect personally identifying information from children without the consent and at the direction of a School. Children and teens under the age of 18 can access parts of the Service and its content, and use certain features, without providing us with personal information. 

However, some content and features available to users of child profiles may require us to collect certain information to support the internal operation of the Service.  We only collect as much information about a child as is reasonably necessary for the child to participate in an activity or educational module, and we do not condition a child’s participation on the disclosure of more information than is reasonably necessary. 

  1. How are child profiles associated with a School account created?

An authorized representative of the School must purchase a user license, register for an account with SurfWisely, and agree to the terms of our Terms of Service, Privacy Policy and this Children’s Privacy Notice. During the account creation process, the School may create individual profiles for each child authorized by the School to use the Service through the account. Each child user profile must be associated with a School account, and children cannot access the Service without the school first signing in to the account with the School’s login credentials. After the School logs into an account, the child user selects the child profile to use the Service.

  1. What information does SurfWisely collect from or about children?

Information We Collect Directly

When a School creates an account and sets up profiles, the School provides information about the child(ren) to SurfWisely directly through the School’s account or using an integrated third party service.  For example, a School can choose to provide information through an integration with a learning managing system.  Information Schools can provide includes, but is not limited to, a child’s name, student identifier, and a profile avatar. This information is used to provide the Service to the user of the child profile. We recommend that the School selects a profile name that does not include the real name or identifying characteristics of the child.

Within a child profile, the user may change the child’s name or profile avatar.  The School will be able to see these changes, and can make modifications through the School’s account.

SurfWisely will communicate messages about the account and children’s activity to email addresses provided by users of School accounts. For example, we may send information regarding subscription notices and password resets, and the child user reports and awards.

Information Collected Automatically

We use technology to automatically collect information, including through use of a child’s profile, when users access and navigate through the Service.

For example, we may collect traffic logs that provide information about the use of the Service and communication data submitted, such as progress and answers to questions. This allows us to provide progress reports and awards.  We also collect information about the device used to access the services, which we use for the support of our internal operations.  This may include an IP address, browser type, language preferences, and similar information. This information is typically collected through a variety of tracking technologies, including cookies, web beacons, log files, and similar technology, and we may use third party providers to collect this information on our behalf.

We use this information to secure and improve the Service, and to deliver a more personalized experience, including by storing information about your preferences, recognizing you when you return to the Service, and providing you with better technical support.

3. Does SurfWisely disclose children’s information to third parties?

Except as described herein, SurfWisely does not share or disclose the information collected from a child through use of a child’s profile with third parties.

We may share information with third parties that we use to support the internal operations of the Service and who are bound by contractual or other obligations to use the information only for such purpose and to keep the information confidential. 

We may also share information, including information collected through a child’s profile:

  1. if we are required to do so by law or legal process, such as to comply with a court order or subpoena or to respond to any government or regulatory request;
  2. if we have a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary (i) to protect the safety of a child, (ii) protect the safety or security of the Service, or (iii) to enable us to take precautions against liability; and
  3. to law enforcement agencies for an investigation related to public safety.

In addition, if SurfWisely becomes involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of its assets, personal information may be transferred or disclosed in connection with the business transaction, subject to any applicable laws.

The Services do not enable users to make information publicly available through a child profile.  No other third-party operators may collect or maintain personal information from children through the Service.

4. How can the School access and delete a child’s personal information?

The School can review or have deleted any a child’s information, including information updated in or collected through a child profile.  The information collected from the user of the child profile can be reviewed at any time by signing in to the School account. The School may also refuse to permit the further collection of the child user’s information by no longer providing the child user access to the Service through the School’s account.

SurfWisely will retain the personal information collected from and about the user of the child profile for as long as necessary to provide the Service and will de-identify or delete information collected through a child’s profile after the termination of the School’s subscription account. To request that the personal information of a user of a child profile is deleted or anonymized at any time, please contact us at info@surfwisely.com.
